EU S.C.A.

Complaint against PayPal (Europe) S.à r.l. et Cie, S.C.A. This is a credit institution, that is a bank, authorised and supervised by Luxembourg’s financial regulator, the Commission de Surveillance du Secteur Financier (CSSF).

## PayPal EU: how to recover money

This entity serves customers in Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Faroe Islands, Finland, France, Germany, Gibraltar, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, San Marino, Slovakia, Slovenia, Spain, Sweden, United Kingdom, Vatican City, Mayotte, Reunion, French Guiana, Guadeloupe and Martinique.

Some people got their money by doing the following:

1. Complain about the false damages claim to PayPal directly and wait for at least one month, or until you get an initial reply.
2. File an official banking complaint against them, because PayPal is a bank in the EU: [CSSF complaint form](https://reclamations.apps.cssf.lu/index.html?language=en). If the link gives an error, [the form is also published here](https://drive.google.com/file/d/1EAiCuprhnrRrfm5b6HC7yw60xCmB3N2_/view?usp=sharing) and can be sent by post or fax.
3. Attach all the required documents with the form.

## Sue PayPal Europe

If the CSSF failed to recover your money and your claim is within the 5,000 EUR range, then file a small claim in the EU against PayPal Europe under the [European small claims procedure](https://europa.eu/youreurope/business/dealing-with-customers/solving-disputes/european-small-claims-procedure/index_en.htm).

## What are the PayPal AUP?

AUP is the PayPal Acceptable Use Policy: the rules that state what you are allowed to buy and sell. PayPal is allowed to change them at any time.

The PayPal User Agreement provides for liquidated damages of $2,500 US dollars per violation, which may be debited directly from the account.
