US Holdings

Complaint against PayPal Holdings, Inc (San Jose, California). NOT REGULATED. This is their main entity owning everything worldwide serving mainly US customers.

Anyone from any country can still sue them directly there in the USA as there are no laws prohibiting that.

## PayPal US: how to recover money

A class action lawsuit was started regarding this by Attorney Eric Bensamochan. The joining form was published for people who wanted to join and to be considered as one of the main plaintiffs. Anyone from any country and any amount could join and there were no upfront fees. The process takes a long time.

## Litigating in the United States

If you want to get your money faster by litigating in the USA you are better placed finding your own lawyer willing to work on contingency, or filing a claim in the local small claims court. Lots of people got their money by just sending a demand letter through a lawyer.

If you are in the US and cannot afford hiring a lawyer you can use a mediation service such as fairshake.com, which may help you reach a settlement with PayPal but usually for less than half of your money. The result varies with your negotiation.

## What are the PayPal AUP?

AUP is the PayPal Acceptable Use Policy: the rules that state what you are allowed to buy and sell. PayPal is allowed to change them at any time.

The PayPal User Agreement provides for liquidated damages of $2,500 US dollars per violation, which may be debited directly from the account.
